Supreme Court Orders PIA to Clear 24 Years Pension Arrears

ISLAMABAD: The three-judge bench, presided over by Justice Shahid Waheed, considered the petition by Mustafa Ansari, a former employee, who filed it with the highest court after attempts to enforce previous judicial orders concerning his pension dues were unsuccessful.

The case pertains to a delay in the payment of pension to the petitioner due to a pension dues after he had retired from work in 2002 based on a particular scheme. According to the counsel representing the petitioner in court, there was delay in paying him even when others were paid.

Sindh High Court had already decided in favor of providing the pensions to the petitioner. However, the concerned authorities failed to clear the arrears in spite of repeated litigation against them.

Justice Shahid Waheed raised queries about the legality of the procedure followed by the airline for disbursing pensions and requested a rationale for the extended period taken. The court was apprehensive about the non-compliance with previous court orders.

Counsel for PIA sought more time to consult the management of the airline in order to settle their dues. The court ordered the airline to sort out this issue before the next session of the court.

The court also made a threat by saying that in case of any failure to comply with the directive, the managing director of Pakistan International Airlines (PIA) will have to show up before the court to justify the delay in execution of its decision.

The legal professionals have observed that the judgment reaffirms the role of judicial intervention when it comes to cases pertaining to rights and responsibilities of employees, especially in cases where delays occur with regard to payments made by organizations in the public sector.

This development has taken place during the efforts by PIA to reconstruct itself and connect abroad. The airline company had restored its operations to London after a considerable period of time, which marked the start of its reconstruction process.

In the words of authorities, resumption of international flights is an effort on the part of the airline to rejuvenate its flight network and obtain better financial performance. Moreover, there will be an increased frequency of flights from Pakistan to the UK due to growing demand.

On the other hand, there are analysts who argue that growth in operations goes contrary to the existing administrative and financial issues, such as late payment of salaries. The recent disruption of flights to some Middle Eastern destinations further emphasized this pressure.

They suggested that the synergy between expansion efforts and internal problems highlights the necessity for better governance and management practices in the airline.

The Supreme Court’s judgment clearly signals that authorities will enforce employee rights and require public bodies to meet their financial obligations. The legal experts opined that the court's judgment could pave the way for other such cases of deferred pensions.

They further emphasized that continuous adherence to the court’s orders and the transparency of administrative procedures will be crucial in regaining the trust of the public in state-owned organizations.

The case will be back before the court as it considers its compliance with the order, especially whether PIA makes timely payments of the arrears.
