Six Years After His Death K-Electric Finally Pays, Rs13.5 Million for a Preventable Electrocution

KARACHI: The verdict for the K-Electric electrocution case has finally been announced by the civil court, which ruled in favor of the deceased’s family and ordered K-Electric to pay Rs13.5 million as compensation for the death caused due to a utility pole accident. This historic decision puts all the responsibility on Pakistan’s largest electricity provider to compensate for a death that could have easily been avoided.

The Senior Civil Judge (Central) rendered his decision on a case where there is a recurring trend of negligence from an institution that has been criticized by the citizens of Karachi for years now – a company which is warned by the government regarding public safety issues but does nothing, only to find itself trying to shirk its liability when the inevitable happens.

Death That Would Not Have Happened Otherwise

The K-Electric electrocution incident is one where Sheikh Saad died in 2019 because of the shock caused by electric current from a power line on a utility pole in Karachi. It is evident from the court documentation that there were several concerns presented by the citizens regarding the pole in question and its hazardous live current before the death of Sheikh Saad.

The above sequence of events is the basis upon which the negligence ruling and the damages award were based by the court. The electrocution case by K-Electric does not constitute a situation of an unfortunate and unexpected occurrence. It constitutes a safety hazard that had been noted before and had led to the death of a citizen, who lived for six years in pursuit of justice through the courts.

The Doctrine of Extraordinary Duty of Care Relates to Electricity Distributors

Through his judgment on the K-Electric electrocution case, Senior Civil Judge (Central) stated clearly and unambiguously the legal duty borne by electricity distributors towards the general populace. The judge pointed out that electricity distribution companies have an extra-ordinary duty towards the citizens owing to the fact that the power grid is installed in public areas where mishandling would result in loss of life.

The case explicitly mentioned that the court did not recognize the defense raised by K-Electric regarding the presence of other utility lines installed in the pole used by the electricity distributor company to argue for shared liability. The presence of other utility lines will not relieve K-Electric from its legal and operational responsibilities, according to the ruling.

Presence of Live Electricity in Public Utility Pole Shows Negligence

Most importantly, it is noteworthy that the court set a precedence in the K-Electric electrocution case that would be applicable far beyond the particular instance alone. The existence of live electricity in a public utility pole in itself is an indicator of the neglect on the part of K-Electric — and is a criterion that places the responsibility of proof of negligence on the utility company rather than its victims or their families.

That concept tackles one of the commonest defenses used by electricity firms against electrocution claims – those based on the complicated nature of electricity as an attempt to evade responsibility for simple maintenance.

It was ordered by the court that the Rs13.5 million be paid by the K-Electric within 90 days to the family of the late Sheikh Saad, which is a fixed period of time which does not allow any company to use legal jargon in order to avoid paying compensation.

Legal justice is finally being done for the family of Sheikh Saad through the K-Electric electrocution verdict after having struggled for the past six years for the guilty party to be brought to book via the civil law process in Pakistan. The compensation of Rs13.5 million not only recognizes the monetary damages but also the human suffering caused by K-Electric’s lack of action following repeated warning signs.

Accountability that the Industry Ought to Be Aware Of

The verdict on the electrocution case of the K-Electric will send a strong signal well beyond this particular family and compensation ruling. Any electricity distributor running its business operations within Pakistan must know that this precedent will hold it legally accountable for negligence when complaints of safety violations have been disregarded leading to fatal accidents.

The K-Electric electrocution case verdict serves as a reminder to Pakistan’s millions of electricity customers, who face aging electrical systems, exposed wires, and utility poles in different conditions, that Pakistan’s civil judicial system will take notice of the negligence of electricity companies whenever the latter prefer operational efficiency over consumer safety, irrespective of the number of other wires on the same pole.
