Government Weighs Ban on Energy Drinks for Children Under 16

LONDON: The government in the UK will put an end to the sale of energy drinks to people below 16 years old from April 2027 in England, following an announcement by the Department of Health and Social Care on Thursday. This was after two years of deliberation regarding the dangers associated with high-caffeine energy drinks.

The Scope of the Ban

England bans energy drink sales to individuals below the age of 16 is limited to energy drinks which have caffeine levels above 150 mg per liter of the drink. This regulation does not include such drinks as tea, coffee, as well as ordinary soft drinks such as Coca-Cola and Pepsi.

However, energy drinks such as Red Bull, Monster, Relentless, and Prime have more than 150mg and, thus, will be included in the ban. To provide information on how dangerous these products are, a 500ml can of Monster is said to contain about 160mg of caffeine.

Where This Ban is Applicable

England bans energy drinks sales to persons below the age of 16 is not limited to one particular sales avenue. Sales will not be allowed in any shop, online, restaurants or through vending machines. Business to business sales are excluded from the ban.

Direct responsibility will now lie with the retailers to carry out the age verification process. The failure by any business to comply and sells restricted drinks to persons below the age of 16 shall attract a fine of up to £2,500 per offense.

The Reasons behind the Government’s Choice to Ban Sales of Energy Drinks to Children Under the Age of 16 Years

In this regard, the Public Health Minister, Sharon Hodgson, made it very clear why she decided on this choice by saying that the energy drinks containing excessive caffeine are not suitable for children. It has been seen that most children in England consume these energy drinks, and there is enough evidence regarding their negative impact on them.

Based on the figures provided by the government, it has been estimated that there are around 100,000 children in England consuming high-caffeinated energy drinks on a daily basis. Statistics show that children from disadvantaged backgrounds tend to consume these beverages more often.

Procedure and Schedule for Implementation

The ban will be implemented by secondary legislation passed in accordance with the Food Safety Act 1990. The measures will still be subject to parliamentary approval before their implementation, but officials expect the measures to be implemented in April 2027.

Barbara Crowther, manager of the Children’s Food Campaign, was pleased with the news, pointing out that around 300 million more high-caffeine energy drinks have been bought by kids in just two years after the Labour Party’s pledge to introduce this legislation.

Industry Backlash

There are those who do not support the move. According to a spokesman of the British Soft Drinks Association, the move was unwarranted and not backed by any sound evidence on overconsumption and any possible health risk. This is based on the fact that there already exists a code of practice that has been voluntarily adopted by the association’s members in which the products do not market energy drinks to children under the age of 16.

This move towards banning the sales of energy drinks to those below the age of 16 is occurring at a time when there have been several other initiatives recently regarding the welfare of children in the United Kingdom. There have been some initiatives for the regulation of social media usage among the younger population too.

While it remains clear that the ban will take place, the next step will be to ensure that it is approved by the parliament before April 2027. For retailers, it is about nine months before the ban takes effect as they need time to set up their compliance mechanisms.
